By accessing and using the website at sebastianconcrete.com or by engaging Sebastian Concrete for concrete services, you agree to be bound by these terms and conditions. If you do not agree to these terms, do not use our website or services. These terms apply to all website visitors, estimate requesters, and customers.
Sebastian Concrete is a concrete contractor operating in Sebastian, FL and surrounding communities. We provide residential and commercial concrete services including but not limited to driveways, patios, sidewalks, foundations, retaining walls, pool decks, floor installations, and related concrete work.
Services are provided within our operating area. We reserve the right to decline any project at our discretion. The availability of specific services may vary based on our current schedule and capacity.
Estimates provided by Sebastian Concrete are based on information available at the time of the site visit or consultation. Written estimates are valid for 30 days from the date issued unless otherwise stated. Prices are subject to change if the scope of work changes, if site conditions differ materially from what was observed during the estimate, or if material costs change significantly.
An estimate is not a guarantee of final price. If additional work or costs become necessary during the project, we will notify you before proceeding. Additional work performed without prior authorization will not be charged unless confirmed in writing.
Verbal estimates are not binding. Only written, signed contracts constitute an agreement to perform work.
Project start dates are estimates and are subject to change due to weather, permit delays, material availability, or other factors outside our control. We will communicate any schedule changes as early as possible.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after a permit has been submitted or materials have been ordered may result in fees to recover those costs. The specific amount will depend on costs already incurred at the time of cancellation.
Sebastian Concrete reserves the right to reschedule or cancel projects due to unsafe conditions, including severe weather, or circumstances beyond our reasonable control.
Payment terms are outlined in each project contract. Typical terms require a deposit before work begins, with the remaining balance due upon project completion. Specific deposit amounts and payment schedules will be stated in writing before any work starts.
Invoices unpaid after the due date may be subject to interest or collection fees as allowed under Florida law. Sebastian Concrete reserves the right to pause or stop work on projects with outstanding balances.
We do not accept payment in full before work begins. Be cautious of any contractor who demands full payment upfront before a project starts - this is a common warning sign in the construction industry.
Before work begins, you agree to:
We are not responsible for damage to unmarked underground utilities, irrigation systems, or property that was not identified prior to work beginning. If unknown conditions are discovered during excavation or site preparation, we will stop work and notify you before proceeding.
For projects requiring a building permit, Sebastian Concrete will apply for and manage the permit process through the applicable county or municipal authority. Permit fees are typically included in the project contract. We will not begin permitted work until the permit is approved. Any work performed without a required permit at the customer's specific written request is done so at the customer's risk, and we make no warranties regarding compliance with local code for such work.
We stand behind our work and will address workmanship defects that are reported within a reasonable time after project completion. Specific warranty terms, if any, will be stated in the project contract.
Concrete is a natural material and normal characteristics of concrete, including minor surface cracking due to temperature change, shrinkage, or curing, are not considered defects. We do not warrant against cracking caused by tree root intrusion, vehicle loads exceeding the design specification, soil movement due to flooding or drought, or acts of nature.
Except as stated in your written contract, all services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.
To the fullest extent permitted by Florida law, Sebastian Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or our services, including but not limited to loss of use, loss of revenue, or property damage not directly caused by our negligence.
Our total liability for any claim arising from a specific project shall not exceed the total amount paid by you for that project. This limitation applies regardless of the legal theory under which the claim is brought.

If a dispute arises between you and Sebastian Concrete, we ask that you contact us first and give us an opportunity to resolve it directly. Most issues can be resolved through straightforward communication.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any legal action arising from these terms or from services provided by Sebastian Concrete shall be brought in a court of competent jurisdiction in Indian River County, Florida.
These terms and conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to personal jurisdiction in Florida for any dispute arising under these terms.
